Promotion Rules

‘Recommend us to your acquaintances’

1. The Promotion is organised by Domy Banino sp. z o.o. domiciled in Sopot at: 663 Al. Niepodległości Street, 81-855, entered in the entrepreneur register of the National Court Register [KRS] maintained by the District Court Gdańsk-North in Gdańsk, Commercial Division VIII of the National Court Register, under the KRS No. 0000381950, hereinafter referred to as the ‘Organiser’.

2. The Promotion is open to those who have signed the sale booking contract (or declared their willingness to participate in the Promotion) and recommend the purchase of real property on one of the projects pursued by Domy Banino to their acquaintances (hereinafter: ‘Recommending Parties’).

3. Eligible for the Promotion are those Recommending Parties who satisfy all of the above prerequisites:

a) they are natural persons not engaged in mediation in real property trade;

b) they e-mail the data at any time in the period from 01/01/2018 to 31/12/2018 to the following address: sprzedaz@chmara.pl; the particulars should include: the given name, surname, telephone number and e-mail address of the person who will sign the Developer Agreement with Domy Banino between 01/01/2018 and 31/12/2018 and pay instalment I of the property price in accordance with the payment schedule, provided that such recommended person is not, at the time his/her name is reported, in the midst of purchasing real property at any other project implemented by Domy Banino (hereinafter referred to as the ‘Client’);

c) a person in the midst of purchasing real property shall be construed as the person who has initiated talks or commercial negotiations with Domy Banino. Should the same Client be recommended by two different participants, the Client shall determine their priority;

d) the Recommending Party shall ensure that the Client is informed of the e-mailing of his/her personal data. The Organiser shall not be liable for unauthorised disclosure of the Client’s personal data by the Recommending Party.

4. The Promotion shall continue from 01/01/2018 to 31/12/2018, hereinafter: the ‘Promotion Period’.

5. The Recommending Parties who satisfy all of the prerequisites specified in point 3 of these Promotion Rules in the Promotion Period shall be awarded the following prizes:

a) the Recommending Parties who recommend one Client in the manner defined in point 3 shall be awarded the cash prize of PLN 900;

b) the Recommending Parties who recommend two Clients in the manner defined in point 3 shall be awarded the cash prize of PLN 1800;

c) the Recommending Parties who recommend three or more Clients in the manner defined in point 3 shall be awarded the cash prize of PLN 2700;

5. Should the Agreement referred to in point 3 of these Rules be signed by two or more buyers, the e-mailed data of one of the joint buyers shall be deemed the recommendation entitling to one prize. Should the personal data of another of those joint buyers under the same Agreement be e-mailed, they shall not be deemed another recommendation and shall not entitle the sender to another prize, irrespective of whether the data are e-mailed by the same Recommending Party or another person.

6. The prizes shall be presented at the Domy Banino office against signing of the prize receipt record and upon providing all data necessary for the Organiser to issue a PIT-8C notice to the Recommending Parties who have satisfied all of the prerequisites specified in point 3.

7. The ultimate prize amount shall be stated in the prize receipt record.

8. The Organiser reserves the right to call off the Promotion for causes beyond his control.

9. The Organiser reserves the right to alter the conditions of the Promotion or these Promotion Rules at any time for vital reasons, especially in the event availability of the prizes specified in the Rules changes.

10. The personal data of the Recommending Parties and Clients shall be processed in compliance with the regulations of the Personal Data Protection Act of 29 August 1997.

11. The administrator of the personal data of the Recommending Parties and Clients is: Domy Banino sp. z o.o. domiciled in Sopot, its registered office at: 663 al. Niepodległości Street, 81-855. The personal data of the Recommending Parties and Clients shall be processed for the sole purposes connected with the Promotion and presentation of the prizes, and for marketing purposes. The information concerning the Recommending Parties may be forwarded to the Tax Office and other competent authorities under the applicable regulations of the law. The provision of personal data is voluntary. Each Recommending Party and each Client enjoys the right of access to his/her data and the right to correct them on the terms laid down in the Personal Data Protection Act. Please, send any written communication in matters related with the processing of personal data to the address of Domy Banino sp. z o.o. with the annotation: ‘Personal Data’ [‘Dane Osobowe’].

12. The Organiser shall produce and deliver the PIT-8C information to the prize-winning Recommending Parties and the Tax Office competent for their home addresses. The Recommending Parties awarded the prizes shall be obliged to pay the income tax due on the prize out of their own funds.

13. Any complaints about the Promotion should be made in writing stating the reasons, and e-mailed to: sprzedaz@chmara.pl on or before 31/12/2018.

14. The Organiser shall be obliged to consider any complaint within 14 days following its receipt.

15. Any complaint in conflict with the Promotion Rules, especially its point 13, shall be rejected.

16. Any disputes which might arise from or in connection with the Promotion shall be resolved by the Common Court of jurisdiction over the Organiser’s registered address.

17. No current employees or parties cooperating with Domy Banino may participate in the Promotion.

18. The Promotion these Rules regulate shall not be combined with any other promotions held by the Organiser.
